How to File a Complaint with OSHA

The Occupational Safety and Health Act of 1970 provides employees and their designated representatives with the right to file a complaint and request an onsite OSHA inspection, if they believe a serious hazard is present or if their employer fails to adhere to OSHA standards. Additionally, the Act allows all complainants to obtain a level of anonymity, ensuring their names will not be provided to their employers.

Everyone deserves to work in a safe and healthy environment. If you feel like your personal well-being is in jeopardy due to negligence on the part of your employer, it’s time to speak up. Filing a complaint with OSHA is a simple process that can majorly impact the way your company operates.

How to File a Complaint with OSHA

Ready to submit a complaint to OSHA but not sure how to go about it? Follow these steps to get the process in motion:

  • Submit it Online: Download OSHA’s online complaint form and submit it online to your local OSHA Area or Regional office. Complaints that are signed by you or your representative are more likely to result in an onsite inspection.
  • Mail or Fax it: If you’d prefer to mail or fax your grievance, simply download the complaint form and submit it to the closest OSHA Area Office to your company, as this increases your chance of getting an onsite inspection. For best results, you’ll also want to make sure that you or your representative signs the complaint.
  • Call Your OSHA Regional or Area Office: If you’d rather talk to someone by phone, call your local OSHA Regional or Area Office to discuss your complaint. Use this method or call 1-800-321-OSHA for all emergency situations.

Feeling a little nervous about filing a complaint? Although OSHA will not reveal your name to your employer, it’s only natural to be a bit apprehensive about the process. You can be rest-assured that it is against the law for your company to fire, transfer, demote or discriminate against you in any way for contacting OSHA. In fact, you can even file a discrimination complaint with OSHA if you feel you’ve been treated unfairly, because you’re suspected of submitting a complaint.
